The CCC-ICLP International ADR Center (Guarantee) Ltd. was incorporated under the Companies Act No. 7 of 2007 in 2018, as a not for profit limited liability Company. It’s a joint venture initiative of the Ceylon Chamber of Commerce (CCC)and the Institute for the Development of Commercial Law and Practice (ICLP)

About the joint venture partners

The CCC is the oldest business Chamber in the country and one of the oldest in the region, having been established in 1839 and acquired legal status upon the enactment of the Chamber of Commerce Ordinance, No. 10 of 1895.

The ICLP is a non profit entity incorporated on September 2nd, 1992 (Company number GA 155) under the Companies Act No. 7 of 2007, to achieve a wide range of objectives relating to the advancement of commercial law and practice. The ICLP established its Arbitration Center in March 1996 and has provided arbitration services for twenty seven (27) years. The Board of Directors of the CCC-ICLP IADR Center (Guarantee) Ltd. comprise six Directors, three each nominated by the CCC and by the ICLP.

Objects of the Company

The company was established to fill a vacuum in the dispute resolution regime then prevailing in Sri Lanka. The global landscape for better commercial dispute resolution outside of litigation was expanding rapidly, and the options had proved to be effective. It was a response to an urgent need in Sri Lanka for more effective and efficient dispute resolution for investment, trade and business.

The objects of the company are set out in its Articles of Association, as follows :

“ The primary objects of the Company is to establish and operate a Center in Sri Lanka to provide alternative dispute resolution services (“ ADR services”) including Arbitration, Mediation and Negotiation and other such mechanisms (“ADR mechanisms”) as are considered relevant for the resolution of commercial disputes and to do all such things as are necessary therefor, including the following :

  • to provide for the administration of ADR services;
  • to make Rules for all such matters as are relevant to the provision of ADR services by the Center;
  • to provide training for Arbitrators and Mediators and such other resource persons and support staff as may be required to provide ADR services;
  • to provide for a system for the accreditation of Arbitrators and Mediators and other resource persons required to provide ADR services;
  • to establish a panel of accredited Arbitrators and Mediators;
  • to promote awareness of Alternative Dispute Resolution mechanisms for the resolution of commercial disputes, including through seminars and workshops;
  • to conduct academic courses on ADR mechanisms;
  • to collaborate with any company, institution or organisation in furtherance of its objects; and such other objects for the development of Alternative Dispute Resoltuion in Sri Lanka as the members of the company may decide from time to time.

The International ADR Center

In pursuance of its primary object, the Company established the International ADR Center (IADRC).
